Individual Terms of Use of JSA Webdesk E-books Delivery Service and Online Shopping Service

The following Terms of Use (hereinafter referred to as "these Terms”) specify the terms and conditions for using the E-books Delivery Service and the Online Shopping Service on JSA Webdesk (hereinafter referred to as "Service") provided by the Japanese Standards Association (hereinafter referred to as "JSA"). If you do not agree to these Terms, you may not use the Service. By using the Service, you are deemed to have agreed to these Terms and the JSA Webdesk Services Terms of Use.

Chapter 1 E-books Delivery Service

Article 1 (Formation of Order and Agreement for the E-books Delivery Service)

1. The E-books Delivery Service grants you a non-exclusive, non-transferable, single-user license to access E-books delivered through JSA Webdesk.
2. You may place an order via the E-books Delivery Service by following the instructions on the details screen for each E-book.

3. Each agreement regarding the E-books Delivery Service shall be formed at the time you completed the order process on this site. Upon formation of the agreement, you shall agree to all of the provisions regarding E-books in these Terms as well as the following:

   • The right granted to a single user of the E-books does not permit the user to transfer the content of or rights relating to the E-books, but grants the single user a limited and revocable right to use the E-books subject to the E-book provisions in these Terms.
   • You acknowledge and agree that JSA and/or the original copyright owner of the subject content (e.g., the International Organization for Standardization, hereinafter "ISO") are the rights holders of the E-books; that JSA has the authority to enter into this agreement; and that the E-books are protected by the Copyright Act of Japan and international copyright treaties. In particular, where ISO standards etc. are included, you confirm that ISO is the copyright owner of such content.
   • Upon request of JSA, you shall provide JSA or the representatives or accountants designated by JSA with all information necessary to assure compliance with these Terms. You further agree that JSA or the representatives or accountants designated by JSA may enter your company, office, or other premises, upon reasonable advanced notice, to inspect or verify your computer in which E-books are saved to ascertain whether the use of E-books complies with the provisions hereof.
4. After the Agreement regarding the E-books Delivery Service is concluded, cancellations of orders, returns, or exchanges for other items for personal reasons will not be accepted.

Article 2 (Access to E-books)

1. Access to E-books shall be made at your own responsibility and expense (including telecommunication costs).
2. With respect to E-books for which the order process has been completed on this site, you may download one copy of the E-book, and permit a single computer owned, leased or otherwise controlled by you to access the same. You are permitted to receive and use such E-books subject to these Terms and the conditions stated on the details screen of the ordered E-books.

3. The following actions against E-books are prohibited by these Terms:

   • Concurrently using E-books on two or more computers or using the same on a local area network or other network. If your computer malfunctions such that you are unable to access the E-books, you may transfer the E-books to another computer, provided that E-books are removed from the original computer following the transfer;
   • Downloading or storing the E-books on a computer that is used, or intended to be used, by the public (i.e., unspecified or numerous persons);
   • Reproducing, distributing, disclosing, or making E-books in whole or in part available to any third party;
   • Decompiling, disassembling, reverse engineering or otherwise attempting to decipher the source code, or combining, modifying, translating, revising, adapting, lending, renting, leasing, selling, sublicensing, assigning, redistributing, re-licensing or transferring in any other form, or removing or altering the copyright notice (including attribution notices such as “© ISO [year] — All rights reserved.”) on E-books;
   • Making any copies of the E-books, other than one printed copy for personal use and one electronic copy for backup purposes;
   • Removing, circumventing, invalidating or modifying technical protection measures or rights management information; and
   • entering E-books in whole or in part into any form of digital tools, platforms, or Artificial Intelligence (AI) tools, creating derivatives (including translations) of E-books using AI, and under no circumstances uploading the E-books to any publicly accessible Large Language Model (LLM) or using the E-books to train AI models.
4. You are responsible for the consequences arising from your use or possession of E-books.

Article 3 (Delivery of E-books, Etc.)

1. You may receive E-books for which you have completed the order process on this site either by downloading (saving the data to your device for reading or viewing) or by streaming (receiving and playing the data concurrently on your device without saving it), as specified on E-books’ details screen.
2. If JSA wishes to set an expiration date for downloading E-books, or using or streaming the same after downloading, JSA will specify such date on the details screen of E-books you are purchasing. With respect to E-books subject to this restriction, downloading, using or streaming the same after downloading will be disabled after the specified expiration date. Please note that these expiration dates are subject to change.
3. If JSA determines that an E-book contains content that is subject to legal restrictions, infringes upon third-party rights, or exceeds socially accepted norms regarding religion, culture, or customs, JSA may suspend the delivery of E-books without prior notice. In such case, you will no longer be able to download, re-download, or stream the E-books. Such situation shall be handled in accordance with Article 4, Paragraph 3.
4. JSA's responsibility with respect to the delivery of ordered E-books is to make the ordered E-books available for downloading or streaming on this site. You are responsible, at your own expense (including telecommunication charges), for preparing a device and for any operations and communications required to download or stream the E-books.
5. It is your responsibility to confirm whether E-books you intend to order is compatible with your device. Even if the ordered E-books are incompatible with your device, JSA will not accept cancellations, issue refunds, or exchange them for other E-books.

Article 4 (Restrictions on Warranty and Liability)

1. If the E-books for which you have completed the order process are not delivered, if the delivered E-books do not display or play properly in the designated operating environment, or if any other defects occur regarding the E-books or their delivery, you shall promptly notify JSA via the inquiry form.
2. Upon receiving notification of a defect from you, JSA will resolve the defect to ensure that you can receive delivery of the ordered E-books or view the E-books in their proper state. However, if JSA is unable to reproduce the reported defect as a result of its verification, or if the expiration date for downloading or streaming the E-books has passed, JSA shall bear no obligation to take such measures.
3. If JSA is unable to take the measures described in Paragraph 2, JSA will accept the return of the E-books and refund the price paid by you. No interest shall accrue on the refunded amount.

Chapter 2 Online Shopping Service

Article 5 (Formation of Order and Transaction for Products Sold Online and Compliance Items)

1. The Online Shopping Service provides you with the sale and purchase of products offered on JSA Webdesk (excluding E-books; products offered through this service are hereinafter referred to as "Products Sold Online"), as well as the grant of non-exclusive licenses incidental to the sale and purchase of such Products Sold Online.
2. You may order Products Sold Online according to the instructions, such as on the details screen of this site.

3. Each agreement regarding Products Sold Online shall be concluded when you click the “Order Completion Button” on the order process screen. By doing so, you shall be deemed to have agreed to all of the provisions regarding Online Shopping Service mentioned in these Terms in addition to the following:

   • You acknowledge and agree that original copyright owner of the subject content (e.g., ISO) is the rights holder of Products Sold Online that constitute or explain standards (hereinafter referred to as "Standards, etc.”); that JSA has the authority to enter into this agreement; and that Standards, etc. are protected by the Copyright Act of Japan and international copyright treaties. In particular, where ISO standards etc. are included, you confirm that ISO is the copyright owner of such content.
   • Upon request of JSA, you shall provide JSA or the representatives or accountants designated by JSA with all information necessary to assure compliance with the terms of the Agreement. You further agree that JSA or the representatives or accountants designated by JSA may enter your company, office, or other premises, upon reasonable advanced notice, to inspect or verify whether your use complies with the provisions hereof.

4. The following actions against Standards, etc. are prohibited by these Terms:

   • Reproducing, distributing, disclosing, or making Standards, etc. in whole or in part available to any third party;
   • Combining, modifying, translating, revising, adapting Standards, etc.;
   • Removing or altering the copyright notice (including attribution notices such as “© ISO [year] — All rights reserved.”) on Standards, etc.; and
   • entering Standards, etc. in whole or in part into any form of digital tools, platforms, or Artificial Intelligence (AI) tools, creating derivatives (including translations) of Standards, etc. using AI, and under no circumstances uploading Standards, etc. to any publicly accessible Large Language Model (LLM) or using Standards, etc. to train AI models.
5. If you lend, rent, lease, sell, or transfer the media containing Standards, etc., you shall ensure that the recipient complies with these Terms.

Article 6 (Rejection and Cancellation of Orders for Products Sold Online)

1. In principle, cancellations of orders will not be accepted after the order process for Products Sold Online is completed.

2. Upon the occurrence of any of the following circumstances, JSA may cancel a transaction by rejecting your order for Products Sold Online or by sending a notification to the e-mail address you registered, without incurring any liability for compensation or any other responsibility to you:

   • The ordered Products Sold Online are unable to be procured due to an inventory shortage, postponement or cancellation of a product launch or other reasons;
   • The ordered Products Sold Online are returned undelivered due to reasons such as the expiration of the storage period of the transport company in the case of the absence of the recipient, long-term absence of the recipient, incorrect address, or the recipient’s refusal to accept delivery;
   • If you have breached any representations or affirmations in Article 10, Paragraph 2 of the JSA Webdesk Services Terms of Use or the prohibitions in Article 8 thereof, or there are reasonable grounds to believe that you are likely to breach these items; or
   • in other cases where JSA determines that it is inappropriate to accept your order.

Article 7 (Return and Replacement of Products Sold Online)

1. If Products Sold Online delivered to you have defects, such as the wrong article being delivered, incorrect collation, damage, or stains, you may request JSA to replace the article with a non-defective one. However, you may not request the replacement of advertisement materials or anything other than the article itself, including outer boxes, packing materials, wraparound bands and fliers for the article, nor may you request the replacement of the article for reasons such as damage to or stains on anything other than the article itself. Please note that the period during which you may request the replacement of Products Sold Online is eight days including the date of arrival of the article.
2. JSA will not accept any requests for the replacement or return of Products Sold Online except as provided in this Article or other Articles set forth in these Terms.

Chapter 3 Miscellaneous

Article 8 (Damages)

If you, whether intentionally or through negligence, violate these Terms and cause damage to JSA, ISO or any third parties including the original rights holders of Standards, etc., you shall be liable to such parties for damages.

Article 9 (Governing jurisdiction)

For all disputes with respect to these Terms, Tokyo District Court shall be the exclusive jurisdiction court of first instance.
