Individual Terms of Use of JSA Webdesk E-book Delivery Service and Online Shopping Service

These individual Terms of Use (hereinafter referred to as "these Terms”) set forth the terms and conditions for using E-book Delivery Service and Online Shopping Service on JSA Webdesk operated by the Japanese Standards Association (hereinafter referred to as "JSA"). If you are not willing to be bound by these Terms, you cannot use the services provided by JSA in connection with JSA Webdesk. If you use E-book Delivery Service or Online Shopping Service through JSA Webdesk, you are deemed to have agreed to these Terms and the JSA Webdesk Services Terms of Use.

Chapter 1 E-book Delivery Service
Article 1 (Formation of Order and Agreement for E-book Delivery Service)

  1. In E-book Delivery Service, a non-exclusive, non-transferable license to access an e-book delivered by JSA Webdesk is granted to you as a single user.
  2. You are allowed to make orders in E-book Delivery Service in accordance with the procedure specified on the explanation screen of relevant e-books.
  3. Each agreement regarding E-book Delivery Service shall be established at the time you complete the order procedure on this site. You shall be deemed to have agreed to all of the provisions regarding e-books mentioned in these Terms in addition to the following:
    (1) The right granted to a user of an e-book does not allow the user to transfer the content of or the rights relating to the e-book, but grants to the user a limited and revocable right to use the e-book in accordance with the provisions concerning e-books in these Terms.
    (2) You acknowledge and agree that e-books are the property of JSA and that JSA has the authority to enter into an agreement and that e-books are protected by the Copyright Act of Japan and international conventions on copyrights.
    (3) You shall provide JSA or the representatives or accountants designated by JSA with all information necessary to assure compliance with the terms of the Agreement. You further agree that JSA or the representatives or accountants designated by JSA may enter your company, office, or other premises to inspect your computer in which the Product is installed to ascertain whether the use of the Product complies with the provisions hereof.
  4. After the Agreement regarding E-book Delivery Service is concluded, you are not allowed to cancel the order, return the article, exchange it for another article or otherwise at your convenience.

Article 2 (Access to E-books)

  1. You shall access e-books at your responsibility and cost (including telecommunication costs).
  2. With respect to an e-book for which you completed the order procedure on this site, you may install one copy of the Product on, and permit a single computer owned, leased or otherwise controlled by you to access the same. You are allowed to receive and use an e-book for which the order procedure has been completed, in accordance with these Terms and the conditions stated on the screen that provides an explanation of the e-book ordered.
  3. The following actions are prohibited by JSA, except as permitted by the Copyright Act or other applicable laws:
    (1) Concurrently using an e-book on two or more computers or using the same on a local area network or other network. In the event that your computer malfunctions such that you are unable to access the Product, you may transfer the e-book to another computer, provided that the e-book is removed from the computer from which it was transferred;
    (2) Installing an e-book on a computer that is used or will be used by the public (many and unspecified users);
    (3) Decompiling, disassembling, reverse engineering or otherwise attempting to decipher the source code, or combining, modifying, translating, amending, adapting, loaning, renting, leasing, selling, sublicensing, transferring, redistributing, re-licensing or transferring in any other form, or removing the copyright notice on an e-book;
    (4) You may make a hard copy of an e-book for your own use and one electronic copy for your own backup, but shall not copy the e-book in any other manner; and
    (5) Removing, circumventing, invalidating or modifying technical means for protection or information on rights and restrictions.
  4. You are responsible for the consequences of any use or possession of an e-book.

Article 3 (Delivery of E-books, Etc.)

  1. You may receive an e-book for which the order procedure has been completed on this site either by downloading (reading or viewing the data saved in your terminal) or streaming (reading or viewing by receiving and playing concurrently without saving the data in your terminal), as specified on the e-book explanation screen.
  2. If JSA wishes to set an expiration date for downloading an e-book, or using or streaming the same after downloading, JSA will specify the date on the explanation screen of the e-book you are purchasing. With respect to an e-book subject to this restriction, downloading, using or streaming the same after downloading will be disabled after the specified expiration date. Please note that the terms are subject to change.
  3. In the event that JSA determines that an e-book contains a description that is subject to restrictions under laws and regulations, infringes another person’s rights, or exceeds the scope of socially accepted practices in terms of religion, culture, custom, etc., JSA may, without prior notice, suspend the delivery of the e-book. In such case, you will no longer be able to download, re-download, or stream the e-book. This shall be handled in compliance with Article 4, Paragraph 3.
  4. JSA's responsibility with respect to the delivery of e-books ordered is to make the ordered e-books available for downloading or streaming on this site. You are responsible, at your cost, for the preparation of a terminal, as well as the operation, telecommunication, etc. related to downloading or streaming the e-books (including telecommunication costs).
  5. It is your responsibility to confirm whether or not an e-book to be ordered is compatible with your terminal. Even if the e-book you ordered is not compatible with your device, JSA will not accept your request for cancelling the order, providing a refund or exchanging the e-book for another e-book.

Article 4 (Restrictions on Warranty and Liability)

  1. In the event that an e-book for which you have completed the order procedure is not delivered, or the e-book delivered is not displayed or does not play properly in the specified operating environment, or other defects occur in the e-book or the delivery of the e-book, you shall notify JSA immediately by using the inquiry form.
  2. When you notify JSA of the occurrence of a defect, JSA will repair the defect to ensure that the ordered e-book is delivered to or accessible by you in perfect condition. However, in the event that the defect reported does not reappear during JSA’s examination, or the expiration date for downloading or streaming the e-book has passed, JSA will not be responsible for offering such services.
  3. In the event that JSA fails to take the actions provided in the preceding Paragraph 2, you can return the e-book to JSA for a refund of the product price paid. The money will be refunded with no accrued interest.

Chapter 2 Online Shopping Service
Article 5 (Formation of Order and Transaction for Articles Sold Online)

  1. You may order an article sold online in the manner provided on the explanation screen, etc. of this site.
  2. A purchase order for articles sold online shall be deemed completed when you click the “Order Completion Button” displayed on the order procedure screen.

Article 6 (Rejection and Cancellation of Orders for Articles Sold Online)

  1. In principle, you are not allowed to cancel an order after completing the order procedure for articles sold online.
  2. Upon the occurrence of any of the following circumstances, JSA may cancel a transaction by rejecting your order for an article sold online or by sending a notification to the e-mail address you registered, without incurring any obligation to compensate or any other liability to you:
    (1) The ordered article sold online is unable to be procured due to an inventory shortage, postponement or cancellation of a product launch or other reasons;
    (2) The ordered article sold online is returned undelivered due to reasons such as the expiration of the storage period of the transport company in the case of the absence of the recipient, long-term absence of the recipient, incorrect address, or the recipient’s refusal to accept delivery;
    (3) In the event that you have breached the representation or affirmation in Article 10, Paragraph 2 of the JSA Webdesk Service Terms of Use or the prohibitions in Article 8 thereof, or there are reasonable grounds to believe that you are likely to breach these items; or
    (4) In other cases where JSA determines that it is inappropriate to accept your order.

Article 7 (Return and Replacement of Articles Sold Online)

  1. In the event that an article sold online that is delivered to you has defects, including the case where the wrong article is delivered, the collating is incorrect, or there is damage to or stains on the article, you may request JSA to replace the article with a non-defective one. However, you may not request the replacement of advertisement materials or anything other than the article itself, including outer boxes, packing materials, wraparound bands and fliers for the article, or the replacement of the article for reasons including damage to and stains on anything other than the article itself. Please note that the period that you may request the replacement of an article sold online is eight days including the date of arrival of the article.
  2. JSA will not accept a request for replacing or returning any articles sold online except as provided in this Article or the other Articles set forth in these Terms.
